Can a Passenger in My Car Sue Me if I’m Not at Fault?

If someone is injured while riding in your car due to someone else’s negligence they could be entitled to your insurance benefits. For example, if someone else causes an accident and your passenger is injured they could file a claim against your personal injury protection (PIP) benefits if they don’t own a car and have a car insurance policy of their own.

Either scenario doesn’t mean that your passenger will sue you, it just means they are eligible to use your car insurance benefits.
