A big challenge for any Florida personal injury lawyer is trying to get clients compensated for lost wages when the client makes a lot of money through tips or commissions. Often times clients will say the amount of money I really lost is X but my tax return will show the I’ve only lost x.

When people don’t claim all of their income on their tax returns they are really hurting themselves. Not claiming all of your income on your taxes makes it very difficult to prove how much income you lost if you ever have to be out of work for an extended period of time due to an accident and/or injury.

We have to explain to our clients that since they can’t prove how much they really made they will have to claim what they filed on their taxes as their typical income. We know this is oftentimes upsetting for a client to hear, but in our last 25 years of experience, we know that jurors won’t take to kindly to hearing that someone wasn’t paying their fair share of taxes and will almost always refuse to pay them for wages they can’t prove they lost.
