Defendants Can’t Videotape Plaintiff’s Medical Examinations In Lawsuits

The Florida Fifth District Court of Appeal recently decided that defendants in personal injury lawsuits cannot videotape medical examinations of plaintiffs. In personal injury lawsuits, defendants are allowed by the Rules of Civil Procedure to have the plaintiff examined by a doctor of the defendant’s choosing. In Prince v. Mallari, the Fifth District Court of Appeal decided that the plaintiff has certain privacy interests that were paramount to the defendant’s interest in winning their case.
