If I Have Collision Insurance On My Car, Does It Matter Who Is At Fault For The Accident?

Collision insurance is an optional coverage in Florida that will pay for the damage to your vehicle no matter who is at fault. Almost every collision insurance policy includes a deductible of some kind. The deductibles can range from $500-$1,000 depending on the policy.

Since we represent a lot of clients that have been involved in car accidents, we often get asked if it matters who the at-fault driver is when someone has collision insurance. The answer is typically always the same – if you don’t mind paying the deductible and using your collision insurance you can choose to do that. It is often the quicker route to getting your car fixed sooner.

The other option is to not use your collision insurance and let the at-fault driver pay with their property damage coverage. You would have to file a property damage claim and wait for their insurance company to get in touch with you. While this option may take longer to get your car fixed, it shouldn’t cost you any money out of your pocket.
