We have many clients injured in accidents that are on Medicare so we frequently get asked a lot of questions about how that will impact their case. Being a Medicare patient will not hurt your personal injury claim and actually holds a couple of benefits.
When someone who has Medicare is injured in a car accident Medicare will only kick in once all the benefits of the at-fault driver’s auto insurance policy and/or the injured party’s insurance have been exhausted. Once those benefits are exhausted then Medicare will start paying the remaining bills based on whether the hospital or doctor accepts Medicare.
It is important to remember that any money that Medicare spends to pay for accident-related medical expenses will have to be paid back to them if there is a settlement made. Medicare does, however, give the injured party a discount and doesn’t make them pay back the full amount that Medicare paid out.
