We have had several instances where our client was a passenger in a car and involved in a car accident. One of the first things they want to know is what their legal rights as a passenger are. Nobody wants to be involved in a car accident, but sometimes being a passenger in a car accident is better than being a driver.

In the state of Florida if you are a passenger in an accident then you would turn to your own Personal Injury Protection (PIP) insurance to cover your injuries. However, if you don’t have PIP, say you don’t drive so you don’t have insurance, then you might be eligible to use the PIP benefits of a resident relative. Now if you don’t live with a resident relative who has PIP benefits then you would be entitled to the PIP benefits of the person in whose car you were riding in during your accident. If the driver of the car you were in doesn’t have PIP coverage then you would be entitled to the PIP benefits of the driver who hit you.

Typically, when a passenger is involved in a car accident there is always someone’s insurance who can be held reliable for the passenger’s injuries. If PIP insurance isn’t available then you would start looking into uninsured or underinsured motorist coverage.
