Should I Talk To The Other Driver After A Crash?

We are often asked if we recommend a plaintiff talk to a defendant immediately after a car accident. Our common answer is yes but with caution. I would always recommend, if you can, get out of your car and go make sure the other driver doesn’t need medical attention. If you are in need of medical attention than that should be your primary focus. Once you have determined nobody is seriously injured then you should exchange insurance information.

Anything beyond that, we highly recommend you watch what you say. You don’t want to admit any blame for the accident or say something that might insinuate you are accepting any blame. Additionally, you should never get into an argument with the other driver. We’ve had a few clients that have exchanged words, even curse words, with the other driver after the accident and it came up later in the case and that never looks good.

At the end of the day it is really up to you whether you want to talk to the other driver. We do recommend, at the very least, that you exchange insurance information with the other driver. Anything beyond that is a personal preference.
