One of the things that we try to do early in the attorney-client relationship is make sure that we are “on the same page” when it comes to expectations. Some clients come to us under the impression that every personal injury case is worth millions of dollars. Most cases aren’t.
Without a doubt, there are personal injury settlements and jury verdicts on a regular with values in excess of a million dollars. But out of the thousands and thousands of personal injury cases that get resolved every day in Florida, million dollar results are very, very rare.
I recently had a client who had suffered a knee injury in an accident and undergone a couple of surgeries tell me there was no way that he would consider accepting anything less than $3 million to settle his case. Find out what I explained to him:
Now, it is true that a jury could possibly award him $3 million for his case, but it would be very, very unlikely. When it comes to juries, you can never tell what they might do. The jury might well award our client $2,000 or $3,000 and feel like they were being generous. Jury verdicts are very random things, generally.
As with most cases, if we can secure a reasonable settlement offer from the other side, it is likely going to make more sense for our client to resolve his claim through a settlement.
