In many cases, people can and should settle their own personal injury case. They don’t need lawyers involved. However, here’s something you need to be very careful about if you intend to settle your own case.

People who negotiate a settlement on their own, need to be aware there are certain entities that have what are called subrogation rights. If you settle a case and your group health insurance or Medicare/Medicaid have paid any of your medical expenses, those entities have a right to be paid back out of any settlement that you make. Take it from us, those entities will come out of the case looking for reimbursement. You see, there are procedures in place that will make sure these entities are aware you have a personal injury case.

Therefore, you have to be careful when you settle your case to look out for these things. You do not want to be surprised after a settlement when your insurance carrier or Medicare/Medicaid come out of the woodwork looking to be paid their subrogation rights.
