Throughout the legal process of a personal injury lawsuit there will be a number of different motions filed within the court system. A motion is a written or oral request for a judge to make a ruling about some aspect of the case. There are many different types of motions such as a motion to dismiss, a motion for summary judgement, a motion for extension of time, a motion to enforce settlement, or a motion to compel; just to name a few.
Once a motion is filed with the court, a hearing is scheduled so both parties can meet with the judge and argue their side of the case. The judge will listen to each parties’ arguments either in favor of or against the motion that was filed. Once the judge has listened to both parties and asked any questions he/she wanted to ask, they will then make a decision on the motion in question.
